Terms and Conditions

Agreement between user of https://nynotaryforyou.com & Notary & Apostille Service, Inc. The https://nynotaryforyou.com website (hereinafter referred to as "the Site") is comprised of various web pages operated by Notary & Apostille Service, Inc. (hereinafter referred to as "NAS"). The Site is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the "Terms"). Your use of the Site constitutes your agreement to all such Terms. Please read these terms carefully, and keep a copy of them for your reference. https://nynotaryforyou.com is a E-commerce Site that Provide various services in the following areas: New York Notary Pubic, Apostille & Embassy & Consular Legalization, document retrieval, Criminal Background Record Search, courier service & Translation Services.

Privacy

Your use of the Site is subject to NAS's Privacy Policy. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

Electronic Communications

Visiting the Site or sending emails to NAS constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing. NAS does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. If you are under 18, you may use the Site only with permission of a parent or guardian.

Cancellation/Refund Policy

Requests to cancel processing cannot be honored, nor any refund issued, once your documents are in final stages, or have been authenticated, certified, Apostille/Certification or shipped. Requests to cancel prior to fully processing will be honored, and a 25% cancellation fee will apply to the total cost, plus any fees paid to others to process your order and for return shipping of any original documents if any were sent to NAS. Expedited service fees are NON-refundable and will not be refunded if your document(s) are rejected because of or for any reason or if you cancel your order. Any fees to be refunded will be processed within 30 calendar days.

The method use to return any refund will be up to NAS , Possible refund methods includes mailing your refund by business check, USPS money order, MoneyGram money order, Google wallet, Amazon, credit card, wire transfer or through PayPal.com. Your refund will be sent via United States Postal Service (USPS) First Class Mail Credit Card. If you want your funds return via Wire Transfer, the cost for such Wire Transfer will be at the requesters expense.  A Typical fee Wire Transfer fee maybe as high as $35 or whatever the current bank rate is. Any other method of courier mailing will be at the requestors expense.

If there is not enough funds to return or forward you documents your document will be held according to the terms in the  'Document Disposal Policy'. If there is not enough funds to process your refund because the fees to send you your refund will not be enought to cover  or there will be a zero balance once the charges are paid no refund will be sent.

"Please note our intent is to create a service of exceptional value. I apologize that we've failed to do so in this situation that you have requested a refund. What will it take to make this better for you?"

The Linked Sites are not under the control of NAS, therefore NAS is not responsible for the contents of any Linked Site, including without limitation any link contained in a Linked Site, or any changes or updates to a Linked Site. NAS is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by NAS of the site or any association with its operators. Certain services made available via the Site are delivered by third party sites and organizations. By using any product, service or functionality originating from the the Site domain, you hereby acknowledge and consent that NAS may share such information and data with any third party with whom NAS has a contractual relationship to provide the requested product, service or functionality on behalf of NAS users and customers.

No unlawful or prohibited use/Intellectual Property

You are granted a non-exclusive, non-transferable, revocable license to access and use the Site strictly in accordance with these terms of use. As a condition of your use of the Site, you warrant to NAS that you will not use the Site for any purpose that is unlawful or prohibited by the Terms. You may not use the Site in any manner which could damage, disable, overburden, or impair the Site or interfere with any other party's use and enjoyment of the Site. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the Site. All content included as part of the Service, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Site, is the property of NAS or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices, legends or other restrictions contained in any such content and will not make any changes thereto. You will not modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or in any way exploit any of the content, in whole or in part, found on the Site. NAS content is not for resale. Your use of the Site does not entitle you to make any unauthorized use of any protected content, and in particular you will not delete or alter any proprietary rights or attribution notices in any content. You will use protected content solely for your personal use, and will make no other use of the content without the express written permission of NAS and the copyright owner. You agree that you do not acquire any ownership rights in any protected content. We do not grant you any licenses, express or implied, to the intellectual property of NAS or our licensors except as expressly authorized by these Terms.

Third Party Accounts

You will be able to connect your NAS account to third party accounts. By connecting your NAS account to your third party account, you acknowledge and agree that you are consenting to the continuous release of information about you to others (in accordance with your privacy settings on those third party sites). If you do not want information about you to be shared in this manner, do not use this feature.

International Users

The Service is controlled, operated and administered by NAS from our offices within the USA. If you access the Service from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use the NAS Content accessed through the Site in any country or in any manner prohibited by any applicable laws, restrictions or regulations.

Indemnification

You agree to indemnify, defend and hold harmless NAS, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable attorneys' fees) relating to or arising out of your use of or inability to use the Site or services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. NAS reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with NAS in asserting any available defenses.

Liability disclaimer

THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES INCLUDED IN OR AVAILABLE THROUGH THE SITE MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. Notary & Apostille Service , INC AND/OR ITS SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR CHANGES IN THE SITE AT ANY TIME. Notary & Apostille Service , INC AND/OR ITS SUPPLIERS MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, AND ACCURACY OF THE INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS CONTAINED ON THE SITE FOR ANY PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALL SUCH INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS ARE PROVIDED "AS IS" WITHOUT WARRANTY OR CONDITION OF ANY KIND. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE.

Termination/access restriction

NAS reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of New York and you hereby consent to the exclusive jurisdiction and venue of courts in New York in all disputes arising out of or relating to the use of the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including, without limitation, this section. You agree that no joint venture, partnership, employment, or agency relationship exists between you and NAS as a result of this agreement or use of the Site. NAS 's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of NAS's right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by NAS with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and NAS with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and NAS with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.

Changes to Terms

NAS reserves the right, in its sole discretion, to change the Terms under which the Site is offered. The most current version of the Terms will supersede all previous versions. NAS encourages you to periodically review the Terms to stay informed of our updates. The date of the last update is at the  Bottom of this file

Payment Policy

Our Typical policy is to collect payment prior to processing your documents, on the date of service, when we visit your home or office to provide a service or upon personal courier delivery of your completed work. If you are sending you documents by email or courier mail your document must include a order form, a payment type listed below or electronic payment (e.g. Paypal, bank wire transfer) must be in place when documents arrive.

If you send your documents without payment, your document will not be process until payment is made. If we decide to process your document without having funds in place, your document will not be return to you until full payment has been made.

Commercial Invoices are due upon receipt. A two percent (2%) for corporate invoices and individuals one and a half percent (1.5%) per month Finance Fee will be applicable on all invoices or payments outstanding more than thirty (30) days. Uncollected funds that have aged 120 days will be sent to a collection agency & eventually reported to the various credit agencies if left unpaid. Should it become necessary for NAS to engage the services of an attorney or collection agency to collect monies due, the cost of such attorney or collection agency will be paid by Client.

Credit Card Charges

Your credit card will be charged when you place your order & completed. However, we may place a hold on credit card funds, before charging your order. If we are not able to fulfill your order for any reason your credit card will be refunded according to our refund policy.

Returned Check Fee

All checks returned to Notary & Apostille Service, for any reason, whether physical checks or e-checks, will have a twenty five dollar ($25.00) penalty plus any bank service fees.

Shipping Policy

Turnaround: All orders are shipped within 48 hours of processing, Monday - Friday 9am - 5pm. If you did not pay for a specific courier service NAS, will use  United States Postal Service (USPS) or whatever postal service deemed appropriate. This is a list of typical carriers available to deliver our orders:

  • USPS
  • FedEx
  • UPS
  • DHL

Shipping Rates

If you select FedEx, UPS, or DHL. The rate charged for the shipping of your order is based on how fast do you want your document to arrive, the weight of your document, and the location where the document is being shipped to & the Season, (during the Christmas season FedEx rate tend to be higher). The default shipping method is by USPS Domestic or International Flat Rate. You can change your shipping method if you decide to by paying the additional cost.

Order Tracking

If a tracking number is provided by the shipping carrier, we will update your order with the tracking information. If you request, your order to be returned by First Class Mail, Please note that 1st Class USPS mail will not have a tracking number.

Shipping Documents to Notary & Apostille Service

Under no circumstances, will Notary & Apostille Service be liable for non-delivery, consequential damages that result from delivery of your documents. NAS recommends that you send your documents with a tracking so you can confirm its safe arrival. If your mail is returned to us because of non-delivery, you will be responsible for reshipping cost to you.

Waiting Policy

If a notary has to wait more than 10 minutes to get started, or delayed during a the service, a waiting fee for every 10 minutes delayed will be added. The notary public may have another appointment after yours and it may not be possible to wait very long.

Disputes

Disputes regarding or arising from the use of our services shall have as an absolute maximum limit, the value of the cost of services actually paid; Any such disputes shall be brought to and settled in the Court system of Suffolk County, New York, USA. Both parties select this court as exclusive venue to bring such action, and waive any rights to bring action in another court. Consumers shall hold this agency & it employees, agents harmless for any delays, loss, misdirection or theft of their documents placed with the United States Postal Service, FedEx, DHL, TNT, EMS or by any other delivery agents.

Web Beacons

Pages on our website also may contain "web beacons" (also known as Internet tags, pixel tags and clear GIFs). Web beacons allow third parties to obtain information such as the IP address of the computer that downloaded the page on which the beacon appears, the URL of the page on which the beacon appears, the time the page containing the beacon was viewed, the type of browser used to view the page, and the information in cookies set by the third party. We may use log files to store the data that is collected through web beacons.

Document Disposal Policy

Documents received for processing without funds to cover procsessing cost will be held for sixty (60) days before being destroyed. At our discression, NAS may hold longer than the above time limit, but this does not give up our rights to do so sooner.
