Documents issued in one country which need to be used in another country must be "authenticated" or "legalized" before they can be recognized as valid in the foreign country. This is a process in which various seals are placed on the document.
The sole function of the apostile certification is to certify the authenticity of the signature on the document; the capacity in which the person signing the document acted; and the identity of any stamp or seal affixed to the document. An apostille stamp issued by the New York State Secretary of State is a one page document embossed with the Great Seal of the State of New York. The Apostille includes the facsimile signature of the individual issuing the certificate.
The Hague Convention
On October 5, 1961, many nations joined to create a simplified method of “legalizing” documents for universal recognition. This group of nations is known as the Hague Convention. They adopted a document referred to as an Apostille (apostilla) that is internationally recognized by all member nations.
What does this means to me?
If the country where you seek legalization belongs to the Hague Convention, you will required an Apostille.
If the country where the document will be used is not a party to the Convention, you will have to begin the cumbersome, time-consuming process of obtaining a series of certifications known as the "chain authentication method". This is literally a paper chase in which authorities will have to attest to the validity of a succession of seals beginning with your document and ending with the seal of the foreign embassy or consulate in the United States.

What is a Letter of Exemplification
If you need us to process an Apostille on a Birth or Death Certificate originating from the
five boroughs of New York City (Bronx, Kings, Brooklyn, Manhattan, NYC Queens and Staten Island),
the document must be sent to us together with a
Letter of Exemplification by the New York City
Department of Health, Bureau of Vital Records. If your document doesn't have the Letter of

Can I use an Apostille for a non Hague Conference country?
In some cases, even though a country is not a signatory to The Hague Conference, the Apostille is still known, recognized and accepted as authentic on a case by case basis. This has come about because of the official governmental source of an Apostille and its inherent simplicity. We cannot however, offer any guarantees that this will be the case. Should you wish to use an Apostille in a non-member country, it is essential that you confirm beforehand whether the entity you wish to present the Apostille document to will recognize the authenticity of an Apostille. It may also be the case that further Legalization or Attestation is required before the Apostille document is recognized as legal. In any case, the first step is the Apostille.
